1. About these terms

These terms govern your use of vasundharaperformance.com and any sale of goods made through it by Vasundhara Performance Solutions Pvt Ltd (CIN U74999TG2016PTC112235), registered office H.No. 10-2-309, Flat No. 201, Sudha Vaishnavi Residency, Street No. 4, West Marredpally, Secunderabad, Telangana – 500026.

By placing an order you accept these terms as they stand on the date of your order. Please read them together with our Shipping & Delivery Policy, Refund & Cancellation Policy and Privacy Policy, which form part of them.

2. This is a business-to-business channel

We supply industrial products to businesses, firms, contractors, institutions and government bodies. By placing an order you confirm that you are ordering for business or professional purposes, and that you are authorised to bind the organisation named on the order.

3. Product information and selection

Descriptions, specification tables, ratings and technical guidance on this site are reproduced in good faith from manufacturers’ published data. Manufacturers revise specifications, part numbers and packing without notice, and images are indicative only.

Responsibility for selection rests with the buyer. Industrial products — surge protective devices, lubricants, welding consumables, fire equipment — must be matched to the actual installation, duty, environment and applicable standard. We are glad to assist and will share manufacturer datasheets, but the final confirmation that a product suits your application is yours, or your consultant’s or contractor’s. Where you are unsure, ask us before ordering rather than after.

4. Prices

• All prices are in Indian Rupees (INR).
• Listed prices are delivered prices — freight to standard serviceable locations in India is included. They are exclusive of GST unless a page expressly states otherwise.
• GST is charged at the rate applicable on the date of invoice.
• For remote and ODA destinations — the North-East, Jammu & Kashmir, Ladakh, Himachal Pradesh, Sikkim and the island territories — freight is quoted separately and confirmed with you in writing before dispatch, and you may cancel for a full refund if it does not suit. • Listed prices are valid for 30 days and are subject to revision without notice, including on account of manufacturer price revisions, statutory levies and exchange-rate movement.
• Where quantity slabs are shown, the applicable slab is determined by the quantity of that item on a single order.
• Items shown without a price are supplied against quotation. Send an enquiry and we will quote.

5. Orders and acceptance

Your order is an offer to buy. A contract of sale comes into existence only when we issue a written order confirmation or dispatch the goods, whichever is earlier. An automated payment acknowledgement is a receipt for the money, not an acceptance of the order.

We may decline an order, in whole or in part, where:

• the item is unavailable or has been discontinued or superseded by the manufacturer;
• a price, specification or availability has been listed in error;
• the delivery location cannot be reliably served;
• the order does not satisfy our compliance, export-control or anti-fraud checks; or
• the quantity or nature of the order is outside what this channel is intended for.

Where we decline an order that has already been paid for, we refund the full amount paid. See our Refund & Cancellation Policy.

6. Obvious pricing errors

If an item is listed at a manifestly incorrect price, we are not obliged to supply at that price even after payment. We will tell you promptly, and you may confirm the order at the correct price or take a full refund.

7. Payment

Orders placed through this website are prepaid in full. Goods are released only against realised payment. There is no cash on delivery on this channel.

Any credit arrangement you may hold with us is governed by a separate written agreement and does not extend to online orders.

Payment is processed by our payment provider on its own secure page. We do not receive or store your payment credentials.

8. GST invoice

We raise a GST tax invoice against the GSTIN and billing details you supply at checkout. Please check them carefully. A tax invoice cannot be amended to change the GSTIN, legal name or place of supply after it has been raised and reported. Orders placed without a GSTIN are invoiced as unregistered supply.

9. Delivery, title and risk

Dispatch and delivery are governed by our Shipping & Delivery Policy. Delivery dates given are estimates made in good faith and are not of the essence of the contract. Risk in the goods passes on handover to the carrier. Title passes on realisation of payment in full.

10. Warranty

Goods carry the manufacturer’s standard warranty and nothing more. We are a supplier, not the manufacturer. We will register, forward and follow up your warranty claim with the manufacturer and assist you through it, but the warranty itself, its duration and its remedies are the manufacturer’s.

Warranty does not apply where the goods have been misapplied, incorrectly selected, incorrectly installed or commissioned, operated outside their rated parameters, modified, repaired by an unauthorised person, stored improperly, or damaged by lightning, surge, flood, fire or other external event beyond the product’s stated withstand rating.

All warranties, conditions and terms implied by statute or common law are excluded to the fullest extent permitted by law.

11. Limitation of liability

We are not liable for indirect, incidental, special or consequential loss, nor for loss of profit, loss of production, plant downtime, loss of data, loss of contract or damage to other equipment, however arising.

Our total aggregate liability in respect of any order, whether in contract, tort, negligence, statute or otherwise, is limited to the invoice value of the goods giving rise to the claim.

Nothing in these terms excludes or limits any liability that cannot be excluded or limited under Indian law, including liability for death or personal injury caused by our negligence, or for fraud.

12. Intellectual property

The text, technical guides, comparison tables, layout and code of this site are our property and may not be reproduced, republished or used to train or populate a commercial database without written permission. Fair quotation with attribution and a link is welcome.

Manufacturer names, brand names and logos appearing on this site are the property of their respective owners. They are used to identify the goods we supply and do not imply any relationship beyond what is expressly stated on the relevant page.

13. Third-party links

We link to manufacturers’ sites, standards bodies and technical resources for your convenience. We do not control them and are not responsible for their content or their privacy practices.

14. Acceptable use

You may not attempt to interfere with the site, probe it for vulnerabilities, place fraudulent or automated orders, or extract its content at scale by automated means. We reserve the right to block access and to refuse service.

15. Force majeure

We are not liable for failure or delay caused by events beyond our reasonable control, including natural events, fire, flood, epidemic, war, civil unrest, strike, transport disruption, power or telecom failure, cyber-attack, manufacturer shutdown, port congestion or any act of government or regulatory authority.

16. Governing law and jurisdiction

These terms are governed by the laws of India. The courts at Secunderabad / Hyderabad, Telangana have exclusive jurisdiction over any dispute arising out of them.

17. Changes

We may revise these terms. The version in force on the date of your order is the version that applies to it. The current version is always on this page.
